      rouge1ful It does beg the question of how Facebook would determine ‘hate postings’! After all, what’s considered hateful in Austria (where the ruling discussed in the video originates) would be very different from what’s considered hateful in South Korea, or Brazil, or England, or Saudi Arabia, or here in the United States! Or even– as you point out– the sensibilities of different American ethnicities, political parties, religious affiliations, & lifestyle choices!

      Hate speech is not speech “considered hateful” to the country it’s speech that labels a group as subhuman, spreads lies about the group, attributes qualities of selected members to the whole, and suggests bringing violence, restricted rights, or extermination of said group. You know, like what Nazi’s and the KKK do. Hate speech is also not whatever some people find “offensive” like Cenk characterized because he’s from the US and isn’t familiar with hate speech laws. Maybe take the time to learn about something before declaring that you know better based on what you infer based on the name of the laws.

      As to how facebook or other platforms could detect hate speech, they can use the same search they use for detecting other forms of banned speech like threats (“We should kill”, “I’m going to murder”). “Free speech” isn’t consequence-free in free countries because they all have libel laws, laws against threats and conspiracy (speech indicating planning of crime), and laws against hate speech exist in places other than the US because we recognize that no one gets to spread lies, dehumanize, and suggest extermination of “undesirable” groups of people. Hate speech is not subjective or determined by place or religion, it’s as clear and wrong as libel, defamation, and threats. The problem you speak of is imaginary because you don’t understand the laws you’re criticizing.

      BTW Even though I’m for laws against hate speech I don’t agree that Austria’s laws, or any country’s ruling, should carry international authority for the reasons Cenk mentioned and basic national sovereignty.

But, what I understood from the video is that the leader of Austria was offended by comments which criticized him, which is hateful speech directed at a specific PERSON, presumably because of questionable habits or policies. Criticizing a leader is not quite the same thing as hurling racial insults. I get the point you’re making, but does it really apply to the Austrian request?

      Facebook have already gone to far with politically motivated censorship. For example, Cenk said some totally reasonable critical things of Islam in the past, if you posted that on Facebook it would be defined as hate speech and removed which is an assault on the freedom of speech

      My great-great grandfather was an Austrian Immigrant during the 1930s. He also owned a tailor shop where I live in the U.S. However his twin brother stayed in Austria and became a Nazi during WW2. He wanted my grandfather to spy on the Armoury where I live because that’s where the U.S military manufactured their weapons during WW2. My grandfather cut-off from his brother after that because they wanted the pictures so they could bomb it. So now I have family in Austria but I’ll probably never here from them because of it. Kind of funny.

      Well , we have other protections in place to counter that something like that would happen , for example the German constitution has an article that states that it is forbidden to alter the human rights provisions stated earlier in the constitution. Here in the Netherlands for any constitutional amendment to be put through there first needs to be a simple majority vote , then an election , then another vote after the election and that vote would need to be a supermajority so at least 66% of both the first and second chamber would need to be in favor of the proposed change to the constitutional statute. There are many more examples but those are just the ones I can come up with at the moment. Also there are protections in place to protect from a judge’s bias, they can be replaced if partiality is proven.

      I think that you are trying a bit too hard here, which is understandable, since TYT did not really understand this issue respectively they did not really clarify the definition of “hate speech” (as it is understood/used in Austria in this case). I think that actually most of the comments that should be banned/deleted from facebook according to Austrian law are illegal also in the US. However, main problem is that facebook does simply not follow their own rules and standards.

      Now TYT understand why us Brits voted Brexit, because the EU will in my opinion want to enforce this- to cover every country in the EU, even though it is a legal ruling in ONE country.
      Very simple example of the EU’s tyranny: in Britain (because we havent left the EU yet) you cannot buy a packet of ten cigarettes, they (not us in Britain) but in Brussels decided that young people (in Britain) would take up smoking easier if they could buy a packet of ten cigarettes. The EU in my opinion want to dictate every area of our lives. Hate speech should be banned (obviously), but legal action should be taken country by country NOT one country to cover ALL countries. Austria thru the EU in my opinion have no business telling other countries what to do.

    Personal defamation, slander etc is illegal in Austria and Germany just as it is elsewhere. The “hate speech” laws (we don’t actually have that term) are about inciting violent behavior or assaults on people’s honor and dignity (a term from the German constitution). The idea behind it is that it’s already too late for the state to step in when violence actually happens, that the state needs to protect minorities and individuals one step before that because of our history. The reasoning is that hateful propaganda and individual intimidation take so many forms, but are causally related to violence, racist acts up to genocide, so the propaganda part is outlawed before enough people get riled up or brainwashed to be a serious danger to society and peace.
