Trump's High court select Neil Gorsuch never ever fulfilled a corporate overlord he didn't worship. Cenk Uygur as well as Ana Kasparian, hosts of The Young Turks, discuss. Inform us exactly what you believe in the remark area below.

" Legislator Al Franken (D-MN), as he claimed himself during Neil Gorsuch's confirmation hearing on Tuesday, made use of to have "a profession in identifying absurdity" as a humorist as well as one of SNL's initial authors.

Actually, his very early job has carried over instead too well to policy making, as he demonstrated while barbecuing Gorsuch concerning his judgment in the supposed "Frozen Trucker instance."

The situation at hand is that of Alphonse Maddin, a truck chauffeur for TransAm. The brakes on Maddin's trailer secured on a subzero January night, and also he called for assistance from TransAm's road solution. They informed him to wait, and he did– for two hours, in spite of discovering that the warmth in his truck taxi was broken. When he was woken by a phone call, he had a numb upper body as well as couldn't feel his feet.

" If you fall asleep waiting in 14 below zero climate, you could freeze to fatality. You can die," Franken described in his retelling of the case." *.

Why didn’t he know the range of temperature he was going to be in and plan accordingly? Doesn’t he have years of expeience as a truck driver?

The multi-billion dollar company I work for recently warned me that they will terminate my employment if I call in sick again. This year, I’ve only had 4 sick leaves, all with a doctors note, and Ontario law says I should be allowed to get at the very minimum 10 sick leaves a year without any sort of punishment. The law aside, my biggest problem with them is that as I technician I work with open powder (ingredients) used to make drugs for sick people, especially for those with immune deficiency. Now the company I work for, wants me to come into work while I’m sick, coughing, sneezing, or puking etc, and work irrespective of the danger this poses to my health and the health of the patients. Just so they can squeeze out a little more money, and any attempt to fight this ends with immediate termination like many other employees before me who have tried.

PS, although the company is in Canada, they primary sale to American drug retailers.

Megan, this was an inexperienced truck driver that made an mistake. He should have known what the weather was like and should have planned ahead. Working at a truck stop for years I have seen truckers do that often. This trucker didn’t and is a liability to the company that could cost them more money in the future.

I grew up in the rural area and I know what it is like. You don’t drive in in inclement weather unless you really have to.

    • Posted by Megan Schmidt, at Reply

+whyamimrpink78 I’m not denying he’s inexperienced, he made a mistake. He could be from a warm southern state traveling through an area he’s never been before. Living in the N. East we had drivers from the south that would come through our area and crash every winter because they didn’t anticipate conditions getting that bad. It’s a mistake, I’m sure he learned from it. I don’t think it warrants firing. When we learn, we make mistakes. Especially being inexperienced, asking him to drive with compromised brakes is beyond irresponsible.

    • Posted by whyamimrpink78, at Reply

Megan, that is how companies run, especially large ones as they can lose millions if someone messes up. You are concerned about this one man’s life but what if that man made a mistake that cost the company millions? That means less jobs, higher prices or something else that hurts other workers or customers.

    • Posted by Megan Schmidt, at Reply

+whyamimrpink78 The loads are insured, the company wouldn’t lose millions. I’m sorry, but I don’t care IF it did cost the company 2 million if it meant this man lived. Lets say hypothetically this driver was your mother, father, husband/wife, sister, etc? Would you still not care if they lived or died over a mistake?

I know this is how companies run, but he didn’t cost them any money and went above and beyond to stay with the load. I’d give him another chance. I help my fiance run his business, he’s had an employee that made an error and cost us quite a large sum of money and he kept him, he learned from his mistake and has been a great employee.

David, judges do not re-write laws. Legislatures do. Judges just interpret and enforce the laws, period. Any judge that re-writes a law should be removed from their position.

    • Posted by David B, at Reply

Sorry Whyamimrpink78 but you have a very simplistic view of judges and there powers. Go and read about the Winterbottom v Wright 1842 case up until that time legislation only recognised “negligence” in respect of a breach of contract. That case set the precedent that people and companies had a duty of care to other people. It created a new part of tort law which did not exist before the 3 judges
(Lord Abinger, Edward Hall Alderson and Sir John Gurney) made there decision. This was continental in the US with the MacPherson v. Buick Motor Co. case go and read it up. Judges do make law as part of the precedent. If you don’t like it change your constitution to remove the consent of English common law from the USA…

    • Posted by whyamimrpink78, at Reply

Sorry David, but your view on judges is wrong. Judges are there to interpret and enforce laws, period. If a law needs to be change it will be done at the legislation level. It is a part of checks and balances so one group does not have too much power. If you give judges to change laws you give them more power. If you don’t like it than change the constitution.

    • Posted by whyamimrpink78, at Reply

David, if a judge made laws there is no need for a legislative branch. Just like how the legislative branch does not solve controversies that arise in cases involve law, the judicial branch does not create laws. It is the balance of powers. Again, if you don’t like it than change the Constitution.

    • Posted by whyamimrpink78, at Reply

David, just because a few judges over reached on their power does not mean that is not the role of judges. Politicians have over reached on their power and the Constitution has been violated before. For example, Kelo vs City of New London violated the 5th amendment. People being placed on the do not fly list are denied their right to due process. You are going off of a couple incidents where judges were wrong and trying to make it the norm. If you do that you create chaos since you remove standards. So again, judges do not write laws, legislatures do. Judges only interpret and enforce laws, period. Don’t like it than change the Constitution.

The truth is, rural poor, dark and brown people choose the military to get out of their neighborhoods and pursue a life. Many join for the college money. A minority actually want to be there, especially among enlisted.

whyamimrpink78 so what’s wrong with merrick garland? If judges are supposed to be non partisan how can you explain all of the 5/4 decisions on party lines. The law says you can’t bribe politicians but that is effectively undone by the supreme court thanks to Republican judges. All you Republicans have been breaking rules politicizing everything. Such hypocrites. SAD!

    • Posted by whyamimrpink78, at Reply

” how can you explain all of the 5/4 decisions on party lines”

That is a problem. Judges are human and are not perfect.

“The law says you can’t bribe politicians but that is effectively undone by the supreme court thanks to Republican judges”

Which is a ruling based on the first amendment. Plus, you can’t bribe judges, there is a difference between that and campaign funds. You can’t remove money from politics.

“All you Republicans have been breaking rules politicizing everything.”

      It goes both ways.

I drive trucks. it’s not fun when it’s below freezing, the truck won’t start, the apu doesn’t start and you’re nowhere near a truck stop. Also, I’ve had my breaks frozen too. You can’t really drive with them on unless you’re on solid ice and even then you have no control over how or which way your trailer swings. Jackknife very likely.

I was once at a receiver delivering and when they finished unloading the trailer, I parked over to the side. I awoke in the morning to find my truck unable to start, apu unable to start and the receiving office closed. I was alone. External temperature was -12 while the internal temperature of the cab was -7. Luckily I still had a little juice left in the battery of the truck to plug up my electric skillet which I turned on and put underneath the covers with me while I waited for help.

    • Posted by 01man01truck, at Reply

Yeah, it certainly can be. Actually, if you look up a list of the most dangerous jobs in America, driving tractor trailers makes the list.

As far as obtaining your CDL, that is one way to go about it. However, as you can see, it’s quite expensive and not many job prospects after completing the course. An alternative path, which I would suggest, is just going straight to the company. Many companies now offer training at their own facilities. Many with the deal that if you work for them for one year once you receive your CDL, you don’t have to pay them back anything. It’s very cost efficient and even more importantly, you’re guaranteed a job right out of school, eliminating both of your reservations.

Lol and then they’re frozen again the next time you pop them. If it’s so cold to where my breaks are freezing, I don’t want to be on the road. I’ll leave it to you super truckers lol

    • Posted by 01man01truck, at Reply

Awe man, I bet you barely even have to deal with it rain now, much less it snowing. Some occasional strong winds but that’s probably the worst of it. Lucky

    • Posted by 01man01truck, at Reply

      +Greg B

Yeah, man, a lot of companies are like that. Fortunate enough for me, my company allows me to stop whenever I don’t feel comfortable driving. I just send them a message on the QC, shut down and update them on the situation in the morning.

But yes you’re right. It’s hard out here. People don’t realize that. It’s much more than just holding a steering wheel. There’s so many dangers out here. And not only is it hard being out here because of all the work and long hours that you put in but then dealing with not even having the basic conveniences that you would have if you were home.
