      I think cne08’s point is that when it comes to being seen as “creepy” or “pervy” men are more likely to be considered than women. Even in this story Ana mentioned the “No Single Males” at this park. That’s plain discrimination based on marital status and gender. I’ve heard similar stories: I believe it was Virgin Airlines that had this policy of males not being allowed to sit next to unaccompanied minors on flights. On a flight, they asked a man to move because he violated this policy, and he got upset, but switched with a woman sitting nearby.

      I remember another story about this female preschool teacher who had sexually abused a number of her students, and people’s comments after this came out revolved around not expecting a woman to be a perpetrator of child predation.

      But, the larger point is that a very small percentage of people, male and female are “creepy”, so making laws that discriminate against an entire demographic because of the actions or threats of a few is inappropriate.

      They were not complaining about pictures being taken while they were in the background. Most reasonable people wouldn’t care about that. The problem is a person the don’t know specifically taking pictures of them.

      Actually taking pictures of someone, or watching someone through an open window is also legal.

      If you open your window you legally accept that whatever can be seen through an open window is now in public view.

      This removes your, “right to privacy.”

    Photography is not a crime. Your eyes can not be trespassed. Glad the courts ruled correctly. If women do not want to be seen or photo’d then don’t put on a bikini and then go out in public.

    This should be a story about a couple of purvey, poorly trained cops hanging around a public swimming pool and falsely arresting a person with a camera caused by projection.
